Different Kinds of Powers of Attorney

A durable power of attorney allows an agent to continue making decisions on the creator’s behalf if they become incapacitated. Unless specific language is used in a power of attorney to make it durable, an agent will lose power to make decisions on the creator’s behalf if they become incapacitated. A springing power of attorney takes effect upon a specific date, condition, or event.
